Federal Challenge Puts Colorado AI Antidiscrimination Law on Hold

After the U.S. Department of Justice (DOJ) filed a federal lawsuit on April 24, 2026, to join the civil action filed on April 9, 2026, by Elon Musk’s AI company, the U.S. District Court for the District of Colorado issued a minute order on April 27, 2026, staying the planned enactment date of the challenged bill. 

The xAI and DOJ lawsuit targeted Colorado’s Consumer Protections for Artificial Intelligence (SB 24-205), a law designed to address “algorithmic discrimination” in high-risk AI systems used in healthcare, employment, housing, education, and financial services. 

The bill defined algorithmic discrimination as “any condition in which the use of an artificial intelligence system results in an unlawful differential treatment or impact that disfavors an invidividual or group of individuals based on their actual or perceived age, color, disability, ethnicity, genetic information, limited proficiency in the English language, national origin, race, religion, reproductive health, sex, veteran status, or other classification protected under the laws of this state [Colorado] or federal law.”
