DENVER (KDVR) — Judge Heidi Kutcher heard about 10 hours of testimony in Denver District Court Monday, over a lawsuit challenging the merits of signature gathering for a statewide ballot initiative.

Colorado voter Michael Hancock is suing the Secretary of State’s Office and organizers of Amendment 87 over how signatures were collected to get the ballot initiative on the ballot.

The initial ballot item would let voters decide to change Colorado’s current flat income tax rate to a six-tier system, bumping up the tax requirements for people and businesses making over $500,000. It would also cut tax rates for earnings less than $100,000.

The first hearing for the case wrapped up around 7 p.m. Monday, and Judge Kutcher said she would issue a ruling by Wednesday as she considers whether any signatures collected for the ballot measure should be thrown out.
