El Paso County defies state sanctuary push, gives deputies ICE powers

On a day when the El Paso County Sheriff’s Office announced the transfer of 16 people to Immigration and Customs Enforcement, its sheriff, Joe Roybal, said Tuesday he intends to enter an agreement that will give his deputies specified powers of an ICE agent.

The 287(g) program authorizes ICE to delegate to state and local law enforcement officers the authority to perform certain immigration officer functions under the agency’s direction and supervision, according to the Immigration and Nationality Act.

The program has three models that local law enforcement agencies can enter into, each that gives the agency distinct powers. A spokesperson for the Sheriff’s Office said they are not ready to comment on which model Roybal would enter into.

Polis open to signing bill restricting local ICE cooperation as Colorado sanctuary debate heats up

Gov. Jared Polis said that while he had “major problems” with an earlier proposal that sought to inoculate immigrants from federal policies, the bill now includes “workable language,” thereby signaling his intent to sign it.

The governor reiterated he is still reviewing the proposal, which underwent several changes before its final passage during the 2025 legislative session.

At its core, Senate Bill 276 reemphasized existing state law that precludes local law enforcers from detaining an individual based on an “immigration detainer.” An immigration “detainer” is a notice issued to federal, state and local law enforcement agencies informing the latter that agents intend to assume custody of an individual no longer subject to the former’s detention.

DENVER (KDVR) — Colorado’s Democratic lawmakers are pushing ahead on immigration bills despite the U.S. Department of Justice filing a lawsuit Friday to challenge those laws.

One of those measures, SB25-276, “Protect Civil Rights Immigration Status,” that lawmakers are pushing forward on, focuses on protecting civil rights and immigrant communities in Colorado and was passed by the House on Saturday after amendments were made. The vote was made along party lines, with Democrats in favor and Republicans opposed.
