D49 Moves to Protect Privacy With Biological Sex Bathroom Policy

By Ashley Eberbach | KDVR FOX31 (COLORADO SPRINGS) — At a special meeting on Wednesday, Sept. 24, School District 49 (D49) voted to enact changes to its bathroom policy, which segregates bathrooms and other private spaces like locker rooms by biological sex. The changes to the district’s policy segregate private facilities according to students’ biological sex, though the district said single-stall bathrooms would be available at each school for any student who requests additional privacy. D49 said the policy allows the district to comply with Title IX, which prohibits sex discrimination in educational programs. “There is no perfect solution to this, there is no perfect answer,” said Lori Thompson, President of the D49 School Board. While many board members stressed the comp...

Colorado Springs District 49 Advances Facility Policy Focused on Biological Sex

By Eric Young | The Gazette School District 49’s board of education discussed a new district policy that would maintain segregation of district facilities based on biological sex during their regular meeting Thursday night. The proposed policy JBAA would establish clear guidelines to separate toilet, locker room and shower facilities between students of opposite sexes, regardless of gender identity. All previous policies or guidance allowing access based on gender identity would be rescinded. Its language goes on to state that it would prevent “a hostile environment by avoiding disproportionate burdens on students of one sex and complies with judicial precedents upholding biological-sex-based separation.” Single-use facilities would also be available at each school bu...

Federal Order On All-Gender Bathrooms Meets Pushback From DPS

By Heather Willard | KDVR Fox 31 DENVER (KDVR) — In late August, the U.S. Department of Education Office of Civil Rights told Denver Public Schools that it violated Title IX protections when it created an all-gender bathroom. Now, the district is asking for a 90-day negotiation period to resolve the allegations. The results of the OCR’s investigation were received by the district on Aug. 28. On Aug. 21, the district announced it had converted a second bathroom to become all-gender. The day after receiving the results, Denver Public School officials issued a statement, pushing back against the Office of Civil Rights’ determination. “At Denver Public Schools, we take pride in leading for Equity at every level of the organization. To our LGBTQ+ students, families, and supporter...

Denver Public Schools Faces Federal Sanctions Over Inclusive Restroom Policy

By: Óscar Contreras | Denver7 The Department of Education found Denver Public Schools violated Title IX by converting a girl’s restroom into an all-gender facility earlier this year. DENVER — Trump’s Department of Education ordered Denver Public Schools to revert all-gender restrooms to single-sex facilities or risk “enforcement action” after finding it discriminated against girls by creating all-gender bathrooms at East High School earlier this year. The investigation, launched by the U.S. Department of Education’s Office for Civil Rights in January of this year, also took issue with a district-wide policy that allows students to use bathrooms that align with their gender identity. By converting a girl’s restroom to a gender-neutral facility and allowing students to use bathro...

DEI at a cost: Colorado schools caught in $70M federal freeze

By Shaina Cole | Contributing Writer, Rocky Mountain Voice Colorado public schools are facing a $70 million funding freeze—part of a broader $6.8 billion nationwide hold triggered by the U.S. Department of Education. At the heart of the conflict are federal objections to DEI and LGBTQIA+ initiatives in schools, which have already led to lawsuits and pushed districts to search for new funding before fall. The freeze and federal justification The funding suspension follows executive orders issued by the Trump administration in early 2025. According to a July 2 notice sent to state education departments, the Department of Education is reviewing already-approved funds to ensure they align with new presidential priorities. Governor Jared Polis responded the same day, calling the act...

Oral arguments will likely be heard later this fall regarding two cases in Idaho and West Virginia. Both cases are focused on state laws that prevent biological males from competing on girls’ and women's sports teams. West Virginia, which enacted the "Save Women’s Sports Act" in 2021, is appealing a lower-court ruling that allowed transgender athlete Becky Pepper-Jackson to compete on the school’s cross-country and track teams. This past year, Pepper-Jackson qualified for the West Virginia gir...

Sey: Our daughters are counting on us to stand up for Title IX

By Jennifer Sey | Commentary, Outkick Not one currently competing female star has spoken up to defend the very category that made their success possible. This is the moment we get real about standing up for women and girls. Even though Governor Gavin Newsom acknowledged in April that it was "deeply unfair" for boys to compete in girls’ sports, the California Department of Education (CDE) and California Interscholastic Federation (CIF) have continued to allow males to compete — and win — in women’s sports.  At the California CIF Championships in June, a male athlete swept gold in the high jump and triple jump and took silver in the long jump, displacing female athletes. Lelani Laruelle should have won gold, with Jillene Wetteland and Julia Teven placing second and thir...

“Not one mention of sexual abuse”: Parents slam Jeffco union as Title IX storm builds

By Heidi Ganahl, Rocky Mountain Voice Jeffco Public Schools is at the center of a storm as teachers and parents clash with Superintendent Tracy Dorland over leadership, transparency, and the district’s handling of cultural and safety concerns.  Tensions hit a breaking point on May 29, when the Jefferson County Education Association (JCEA)—representing roughly a quarter of Jeffco’s 5,000 teachers—declared a vote of no confidence in Superintendent Tracy Dorland. The move came just days before news broke of a federal Title IX investigation into the district. Union leaders accused her of top-down leadership, fostering instability, and eroding trust. They highlighted high turnover in central office staff, the rejection of a board-approved policy on ICE protocols, and the rollback ...
